EPC协议
根据EPC协议,EPC承包商通常于投标程序后,与委托人签署合同,以提供设计、采购及施工服务。EPC合同通常包括国际咨询工程师联合会“银皮书”标准条款。EPC承包商负责将设计、施工及采购所有要素结合起来,并承担供应链的偿付风险。
EPC协议将清晰列载委托人/雇主(除其他事宜之外)进入现场权、允许、许可及批准、受委托人员、财务安排及索赔有关的权利及义务。同样,EPC协议应列载承包商有关履行、其代表、指定的分承包商、资料、价格、进入、货物运输、设备、环保、进度报告及里程碑的一般义务及具体细节。厂房设计有关的条款应包括一般设计义务、承包商的承诺、技术标准及规定。该协议亦应包括(除其他事宜之外)有关延迟及暂停、竣工时及竣工后检验、缺陷及责任、风险及责任、合同价及付款、以及委托人最终接管条款。
